Terms of Service

1. Agreement

These Terms of Service govern your use of ViralCart AI. By creating an account you accept these terms on behalf of yourself and, where applicable, the organization you represent.

2. The service

ViralCart AI provides tools for managing TikTok Shop operations: product research, listing creation, content planning, creator and affiliate management, order and inventory operations, profit analytics, automations, and governed AI agents. Features vary by subscription plan and are enforced server-side.

3. Your responsibilities

You agree to:

• Provide accurate registration information and keep credentials secure.
• Only connect shops and accounts you are authorized to manage.
• Comply with TikTok Shop policies and all applicable commerce, advertising, and consumer-protection laws.
• Review AI-generated output before publishing it; you remain responsible for content you publish and business actions you approve.
• Not misuse the service (no unauthorized access, scraping of other tenants, resale without agreement, or unlawful content).

4. AI features

AI outputs are generated recommendations, not guarantees of business results. Opportunity scores, forecasts, and compliance flags are informational aids and do not constitute legal, financial, or professional advice. Sensitive agent actions require your explicit approval.

5. Subscriptions and billing

Paid plans are billed as recurring subscriptions through PayPal at the prices shown at checkout. Plans renew automatically until cancelled. You can cancel at any time; access continues to the end of the paid period. Taxes may apply. See the Refund Policy for refund terms.

6. Third-party platforms

The service interoperates with third-party platforms (TikTok Shop, shipping carriers, PayPal, AI providers). We are not responsible for their availability or decisions, including shop suspensions or policy enforcement by TikTok. The service degrades gracefully when a provider is unavailable, but we cannot guarantee uninterrupted synchronization.

7. Intellectual property

We retain all rights to the platform. You retain all rights to your data and to content you create with the service. You grant us the limited licence needed to host and process your data to operate the service.

8. Disclaimer and liability

The service is provided "as is" without warranties of any kind to the maximum extent permitted by law. Our aggregate liability for any claim is limited to the amounts you paid for the service in the twelve months preceding the claim. We are not liable for indirect or consequential damages, including lost profits or lost data.

9. Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these terms, create risk for other tenants, or fail to pay. On termination we will make your data available for export for 30 days unless law requires otherwise.

10. Changes and contact
